For foreign companies and investors

How land works in Vaca Muerta

If you are coming from abroad, the first surprise is that the operator of a block and the owner of the land are not the same. These are the questions foreign companies ask before they look at a plot.

Who owns the land in Vaca Muerta: the operator or the landowner?

Two different people. Under the Argentine Constitution, oil and gas in the ground belong to the province, and Neuquén grants concessions over blocks to operators such as YPF, Vista or Shell (the concession holder). The surface belongs to someone else: the landowner, called superficiario. A concession does not give the operator the land, and a plot can sit inside a block whose operator has nothing to do with its owner.

What is an oil and gas easement (servidumbre) in Argentina?

It is the right a concession holder has to use the surface it needs for wells, pads, roads and pipelines, paying the landowner for it (national Hydrocarbons Law 17,319, art. 100, and Neuquén Law 2183). The amount is agreed between landowner and operator, or set by the courts. A planned pipeline that crosses a field brings a right of way of this kind.

Who do I deal with to lease or buy land for a base or a yard?

With the landowner, not with the operator of the block. Leasing, buying or setting up a surface right (derecho de superficie) is a private agreement with whoever owns the plot. The map shows each plot, its area, what surrounds it and how far it is by road from Añelo; owner names are not published, they stay with the landowner.

Can a foreign company buy rural land in Argentina?

Foreign companies can invest in Argentina on the same terms as local ones, and long-term leases and surface rights are common ways to secure land. The rules on foreign ownership of rural land have changed since 2023 and are still being debated, so check the current status with an Argentine lawyer before buying.
